These Terms of Service ("Terms") govern your use of nexflowsolution.com (the "Site") and any services provided by NexFlow AI ("NexFlow," "we," "our," or "us"), a consultancy based in Boulder, Colorado. By accessing the Site or engaging our services, you agree to these Terms.
1. Use of the Site
The Site is provided for informational purposes and to facilitate contact with NexFlow AI. You agree to use the Site only for lawful purposes and in a manner consistent with all applicable laws and regulations. You may not use the Site to transmit spam, malware, or any content that is false, misleading, or harmful.
2. No Professional Advice
Content on the Site — including articles, guides, and tool descriptions — is provided for general informational purposes only. It does not constitute legal, financial, technical, or professional advice and should not be relied upon as such. Specific recommendations are only made within the scope of a signed engagement agreement.
3. Services
NexFlow AI provides workflow automation consulting and implementation services to business clients. The scope, deliverables, timeline, and fees for any engagement are governed by a separate written agreement (Statement of Work or Service Agreement) executed between NexFlow AI and the client. These Terms do not constitute or modify any such agreement.
4. Intellectual Property
All content on the Site — including text, graphics, logos, and code — is the property of NexFlow AI or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without prior written permission.
Workflow systems, automations, and documentation created for a client under a paid engagement are owned by the client upon full payment, unless the engagement agreement specifies otherwise.
5. Third-Party Tools and Links
The Site references and links to third-party tools such as Make, n8n, HubSpot, Airtable, and others. These links are provided for informational purposes. NexFlow AI has no control over third-party sites or services, does not endorse them, and is not responsible for their content, availability, or practices. Your use of third-party tools is governed by their respective terms and policies.
6. Disclaimer of Warranties
The Site and its content are provided "as is" without warranties of any kind, express or implied. NexFlow AI does not warrant that the Site will be error-free, uninterrupted, or free of harmful components. We make no representations about the accuracy, completeness, or suitability of any information on the Site for any particular purpose.
7. Limitation of Liability
To the fullest extent permitted by applicable law, NexFlow AI and its principals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any information obtained from it. Our total liability for any claim arising from use of the Site shall not exceed $100.
This limitation does not affect liability that cannot be excluded or limited under applicable law.
8. Indemnification
You agree to indemnify and hold harmless NexFlow AI, its principals, and agents from any claims, losses, or damages (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Site.
9. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Boulder County, Colorado, and you consent to personal jurisdiction in those courts.
11. Changes to These Terms
We may update these Terms periodically. The "Last updated" date at the top of this page reflects when changes were last made. Continued use of the Site after an update constitutes acceptance of the revised Terms.
